Purpose

These terms govern the use of Bercio, a baby log and baby monitor app working between two phones, published by Téqui Studio (Charles Grimont EI). By using the app, you accept them.

A help, not a guarantee

Bercio is not a medical device. It monitors neither breathing nor heart rate and does not prevent sudden infant death.

An alert may be missed or delayed: Wi-Fi or mobile network down, flat battery, notifications turned off, power saving mode, the phone closing the app, a cry the detection does not recognise. The app never replaces adult supervision or safe sleep recommendations.

The baby log's estimates (naps, bedtime, waking up) start from general guidelines by age: they are not medical advice. For any question about your child's sleep, feeding or health, ask a health professional.

Conditions of access

To use the app, you must:

  • be of legal age;
  • use devices you own or are allowed to use;
  • only film your own child, or a child whose parents have agreed, and inform anyone who may be seen or heard (childminder, family).

Account

The baby log needs an account; the baby monitor works without one. You create your account by signing in with Apple, with Google or with a code received by email, at an address that is yours. An account is personal: each member of a household has their own.

You are responsible for access to your phones and to your email address: whoever uses them can read and change the baby log. Protect your phones with a passcode. If one of them is lost or stolen, remove it from another of your phones (“Shared with”) or delete your account, and write to support@tequi.app if you think someone else is using your account.

Household and sharing

You only create a baby log for a child whose parent or guardian you are, or with their agreement.

Inviting someone gives them access to the household's whole baby log, past and future, with the same rights as you: recording, deleting, inviting, removing a member. Only send an invite to someone you trust, and check the email address of whoever asks to join before accepting. You are responsible for the people you invite.

A person removed from the household keeps what their phone had already received: the household key changes so that they cannot read what comes next, but what they have seen cannot be taken back from them.

Recovery key

The baby log is end-to-end encrypted: the publisher can neither read it nor recover it for you. Keep the recovery key off your phone (on paper, in a password manager), and only share it with members of the household: it opens the whole baby log.

If you lose the recovery key and access to every phone of the household, the baby log is lost: no one, not even the publisher, can give it back to you.

If you think someone else knows the recovery key, create a new one (“New key”): the old one stops working.

Account deletion

You can delete your account at any time, in the app or on the Bercio website (see the privacy policy). Deletion is immediate and permanent: your account and its phones are erased; the baby log stays with the other members of the household, or is erased if you were its only member.

An account unused for two years is deleted, after a warning by email 30 days before. The publisher may also close an account used in breach of these terms.

Good practice

  • Place the baby device more than one metre from the bed, with cable and charger out of the child's reach.
  • Check before each night that the alerts ring (“Test alerts” in the settings) and that the baby device is plugged in.
  • On Android, turn off battery optimisation for Bercio if the phone's maker closes apps in the background.

Prohibited uses

  • Filming or listening to a person without their knowledge.
  • Diverting the app from its purpose, copying it, decompiling it or trying to circumvent how it works.
  • Disrupting the publisher's services (connection, relay, accounts), creating accounts in bulk, trying to access another household's baby log or circumventing the limits of the service.

Free of charge, with ads

The app is free. It is funded by ads on the screens where they are in nobody's way (see the privacy policy), never on the monitoring screen or on the baby device.

Monitoring (picture, sound, detections and alerts) is always free and complete: it never depends on an ad or a payment.

Extra soothing sounds and Premium

Six soothing sounds come on top of the six basic ones: brown noise, shush, fan, hair dryer, summer night and music box. An ad video watched to the end unlocks them for 12 hours, and until the end of a monitoring session started within that time.

The Premium purchase, paid once at the price shown by the store, unlocks these sounds for good and removes all ads. It is tied to the Apple or Google account that paid for it: “Restore my purchases”, on the home screen and in the settings, finds it again on another phone or after reinstalling.

Payment, billing and refunds fall under the terms of Apple (App Store) or Google (Google Play), to whom any request is made. A refunded purchase no longer unlocks anything.

Availability

The app depends on the network, on the publisher's servers (connection, relay, accounts) and on third-party services (Apple, Google, email delivery). The baby log remains usable offline on your phones, and syncs when the network comes back. The publisher does not guarantee continuous operation and may change, suspend or discontinue the app.

Liability

To the extent permitted by law, the publisher cannot be held liable for damage resulting from a missed or delayed alert, an interruption of the service, the loss of the baby log following the loss of the recovery key and of every phone of the household, access to the baby log by a person you invited or to whom you entrusted a phone, or a use that does not comply with these terms. These terms do not limit the rights you have under the law as a consumer.

Changes

These terms may change; the version in force is published in the app and on its website, with its update date. Continuing to use the app means accepting the new version.

Governing law and disputes

These terms are governed by French law. In case of dispute, an amicable solution is sought before any action; failing that, the French courts have jurisdiction, subject to the rules protecting consumers.
